Consumer Data Protection Restructured: Stricter Rules on the Way

In an effort to optimize the balance between economic interests and consumer rights, the Federal Cabinet has adopted an important draft: The amendment of the Federal Data Protection Act aims to give citizens more control over their own financial data. The reform was initiated as a consequence of a decision by the European Court of Justice, which imposed strict requirements on credit assessments of consumers by Schufa and other credit reporting agencies. The new bill will exclude personal information such as residential addresses, names, or data collected from the use of social networks from being considered in evaluating creditworthiness. The reform also sets limits on access to detailed information on payment transactions on bank accounts. The legal review was prompted by a loan applicant's complaint against Schufa. When Schufa disclosed only the score value and general information on the calculation method, without the precise calculation approaches, the ECJ intervened. The collection of Schufa information also plays a key role in landlords' assessments of potential tenants. Steffi Lemke, the Federal Minister for the Environment and Consumer Protection, emphasized the importance of transparency regarding the data used to determine the score value and noted that in the future, no discriminatory factors – such as postal codes – should lead to a negative credit rating. The Minister of the Interior, Nancy Faeser, highlighted that under this bill, sensitive data such as ethnic background or health information must not be considered in the automatic calculation of creditworthiness. Furthermore, the legislative adjustment is intended to simplify research projects by having a competent supervisory authority serve as a central contact point for cross-border projects. The legislation still requires the approval of the Bundestag and Bundesrat before it becomes obligatory. It reflects a growing awareness of data protection in an increasingly digitalized society.
