Negotiation over LNG pipeline at Federal Administrative Court: Environmental associations against acceleration law

In Leipzig, a significant proceeding is currently taking place before the Federal Administrative Court, which could affect the central link in Germany's energy supply: the connection line of a liquefied natural gas terminal on Rügen. This hearing allows the public to take a close look at the legal disputes surrounding the LNG Acceleration Act and energy infrastructure. The German Environmental Aid and the Nature Conservation Association Germany have filed a lawsuit with the aim of overturning the plan approval decision of August 2023. They refer to the groundbreaking law which, following the Russian-Ukrainian conflict, suspended comprehensive environmental impact assessments for such projects to ensure urgently needed energy supply. The gas pipeline already laid connects the regasification vessel 'Energos Power' with important distribution networks on land and is thus a critical component for the independence of German energy supply from Russian gas. Environmental organizations argue, however, that the acceleration law prevents an adequate case-by-case examination for each project. The representation of the defendant Stralsund Mining Authority, on the other hand, argues that the law sufficiently considers the urgency of the project and the current situation of scarcity. The outcome of the proceedings is of far-reaching significance for the future of energy supply and the legal framework of infrastructure projects in times of crisis. The presiding judge of the 7th Senate emphasized in the oral hearing the severe supply gap created by the failure of Russian gas deliveries. A provisional judgment has already been made in favor of the project in prior summary proceedings, but with the main trial, further developments could emerge. Even though the Federal Administrative Court may not have announced its decision yet, it is clear that the legal debates surrounding the LNG terminal are not concluded. The affected municipality of Binz is also considering legal action, which indicates an ongoing controversy over the energy project. With the start of regular operations planned for mid-May and the targeted full capacity in summer, the focus of the public is on the court's decision and its implications for future energy and environmental laws.
