The pre-Christmas period, traditionally characterized by bustling activity in the stores, is undergoing a remarkable transformation this year. According to reports, major brands such as Urban Outfitters, Lush, Gymshark, Uniqlo, and Emma Sleep are increasingly turning to so-called 'freelance' sales forces through gig apps to meet the holiday rush. However, this new practice could have some alarming consequences, as these workers are classified as self-employed and thus miss out on basic labor protection rights.
Tim Sharp, a senior official with the union federation TUC, expressed concern about this trend. He emphasized how incomprehensible it may seem to many that individuals working in a retail store do not receive basic statutory protections. The central question of this discussion is the actual employment status of freelance workers.
Traditionally, stores rely on agency workers during peak season, who at least have entitlement to basic employee rights, including holiday pay and minimum wage. However, platforms like YoungOnes and Temper have now firmly established themselves in the market, promoted by young social media influencers who have a wide audience. These platforms offer businesses a cost-effective means to find temporary help, yet these workers largely stand without legal protection.
Tim Sharp warns that in the future, more companies might exploit this loophole to circumvent existing and new labor law regulations. Although the government plans to develop a simpler, two-tier system that distinguishes between employees and genuinely self-employed entrepreneurs, the problem persists until these reforms are implemented.
A spokesperson for the Department of Business and Trade emphasized that employers should never undermine the labor rights of their employees by falsely designating their status as self-employed.
